Details of claim

On the grounds stated in the statement of claim, accompanying affidavit or other document prescribed by the Rules, the Applicant applies for the following relief under section 39B of the Judiciary Act 1903:

  1. A writ of mandamus, or an order in the nature of mandamus, requiring the Applicant’s 22 July 2024 Originating application for relief under section 39B Judiciary Act 1903 be filed and a proceeding be commenced accordingly; and
  2. A writ of mandamus, or an order in the nature of mandamus, requiring the Applicant’s 27 July 2024 Originating application for relief under section 39B Judiciary Act 1903 be filed and a proceeding be commenced accordingly; and
  3. A writ of mandamus, or an order in the nature of mandamus, requiring the Applicant’s 29 July 2024 Originating application for relief under section 39B Judiciary Act 1903 be filed and a proceeding be commenced accordingly; and
  4. An injunction requiring the Respondent not refuse to file originating process lodged by the Applicant on grounds involving cursory assessment of the merits of the case.
