Details of claim
On the grounds stated in the statement of claim, accompanying affidavit or other document prescribed by the Rules, the Applicant applies for the following relief under section 39B of the Judiciary Act 1903:
- A/an:
a. prerogative writ of “do your job”; or alternatively,
b. writ of quo warranto; or alternatively,
c. injunction
requiring the Australian Human Rights Commission do all of the things necessary to give effect to relevant human rights in relation to matters disclosed by the Applicant to the Australian Human Rights Commission.
- An order declaring:
a. there exist an “Australian Secret Police”; and,
b. there is a “Commissioner” of the Australian Secret Police; and,
c. the Applicant can proceed against the Commissioner of the Australian Secret Police.
Claim for interlocutory relief
The Applicant also claims interlocutory relief.
- An injunction requiring the Office of National Intelligence produce to the Applicant all personal information about him in its possession, custody or power.
- A Rule 16.31 order that the proceeding is to continue on pleadings if neither Respondent:
a. Applies for an order pursuant to subrule 13.01(1); or,
b. Files a notice of objection to competency; or,
c. Applies to the Court for the question of competency to be heard and determined before the hearing of the application. - An order reserving the costs of interlocutory relief.
