I, Jan Marek Kant, give notice, under subsection 98(1) of the Evidence Act 1995, that I intend to adduce evidence of the occurrence of 2 or more related events to prove that, because of the improbability of the events occurring coincidentally, the Federal Court of Australia did a particular act or had a particular state of mind.

Evidence required

  1. A letter to the Applicant from the Federal Court of Australia dated 11 December 2023 and signed Judicial Registrar Curnow.
  2. A letter to the Applicant from the Federal Court of Australia dated 23 December 2024 and signed National Judicial Registrar Edwards.
  3. A letter to the Applicant from the Federal Court of Australia dated 6 March 2025 and signed Registrar Hammerton-Cole.
  4. A letter (with enclosures) to the Applicant from the Federal Court of Australia dated 21 March 2025 and signed National Judicial Registrar Goucke.
  5. Submissions prepared by the Applicant on 28 September 2025 and accepted by the Federal Court of Australia on 29 September 2025 for filing in VID416/2025.

Evidence to establish improbability

  1. The Federal Court of Australia on 30 October 2025 with intention departed from its observable tendency of refusing to file documents without also calling attention to availability of judicial review.
  2. The Federal Court of Australia had intention to cause the Applicant seek judicial review of its 30 October 2025 decision to not file “the Documents” mentioned in its decision statement.
