Details of claim
On the grounds stated in the statement of claim, accompanying affidavit or other document prescribed by the Rules, the Applicant applies for the following relief under section 39B of the Judiciary Act 1903:
- An injunction requiring the First, Second, Third and Fourth Respondents collectively do all things necessary (except compel the Applicant to do things with the use of coercive powers) to bring forth the prosecution and punishment of every person who committed against the Applicant a crime against humanity in the meaning of the Criminal Code.
- An order declaring:
a. there exist an Australian Secret Police; and,
b. there is a Commissioner of the Australian Secret Police; and,
c. the Applicant can proceed against the Commissioner of Australian Secret Police; and,
d. process in proceedings against the Commissioner of Australian Secret Police can be served by delivering copies of it personally to any person appointed by the Attorney-General of the Commonwealth to receive service. - Damages in false imprisonment.
- Ordinary damages including compensation for injury to the Applicant s feelings caused by the First, Second, Third and Fifth Respondents.
- Exemplary damages in amount equal to sum tax revenue of the Commonwealth accrued in tax years beginning the year when the Applicant first was detained by the secret police and ending the year before this proceeding concludes.
- Publication of all written submissions received by the Court in this matter if the application is determined without oral hearing.
Claim for interlocutory relief
The Applicant also claims interlocutory relief.
- A Rule 31.04(b) order that this application and accompanying documents may be served by delivering a stamped copy of each document to a person appointed by the Attorney-General of the Commonwealth to received service, and thereafter be taken to have been served on each Respondent in his official capacity.
