I, Jan Marek Kant, of 3/33 Bewdley Street, Ormond VIC, litigant, affirm:

  1. I am the Applicant.
  2. A reference in this affidavit to a date on which I did something or a thing happened is a reference to a date my records indicate I did the thing or the thing happened.
  3. A reference in this affidavit to a true reproduction of a document is a reference to a reproduction that is true to the extent that my record of the original document was not altered without my knowledge or consent.
  4. On or around 06 September 2024 I produced documents to the Federal Court registry to be filed in a proceeding I sought to commence against the Australian Human Rights Commissioner and others. These documents included:

(a) An affidavit that I affirmed on 05 Sep 2024 and produced to the Federal Court via eLodgment, a true reproduction of which is set out in pages 6 through 9 of “JMK-1”

(b) An affidavit that I affirmed on 05 Sep 2024 and produced to the Federal Court “over the counter’, a true reproduction of which is set out in pages 7 through 535 of “JMK-1″

(c) A “Form 69” originating application I completed on 05 Sep 2024 and produced to the Federal Court via eLodgment, a true reproduction of which is set out in pages 536 through 539 of “JMK-1”

(d) An affidavit that I affirmed on 06 Sep 2024 and produced to the Federal Court via eLodgment, a true reproduction of which is set out in pages 540 through 669 of “JMK-1”

  1. On 06 September 2024 I received from the Federal Court an email advising that the documents referred to in paragraph 4 above were under review. A true reproduction of the email is set out in page 670 of “JMK-1”.
  2. On 12 November 2024 I received from the Federal Court an email concerning documents referred to in paragraph 4 above. A true reproduction of the email is set out in page 671 and 672 of “JMK-1”.
  3. On 10 February 2025 I produced to the Federal Court registry, via eLodgment, documents that I intended to have filed in a proceeding I sought to commence against the Australian Human Rights Commissioner and others. These documents included:

(a) An affidavit that I affirmed on 10 Feb 2025, a true reproduction of which is set out in pages 674 through 710 of “JMK-2”

(b) A “Form 18” notice that I completed on 10 Feb 2025, a true reproduction of which is set out in page 711 of “JMK-2”

(c) A “Form 69” originating application I completed on 10 Feb 2025, a true reproduction of which is set out in pages 712 through 714 of “JMK-2”

  1. On 14 February 2024 I received from the Federal Court an email advising that the documents referred to in paragraph 7 above were reviewed by a Registrar but not considered by “the Duty Registrar’. A true reproduction of the email is set out in page 715 of “JMK-2”.
  2. Also on 14 February 2024, I received from the Federal Court an email in reply to an enquiry I made earlier that day. A true reproduction of this email is set out in page 716 and 717 of “JMK-2”.
  3. On 17 February 2025 I produced to the Federal Court registry, via eLodgment, documents that I intended to have filed in a proceeding I sought to commence against the Australian Human Rights Commissioner and others. These documents included:

(a) An affidavit that I affirmed on 17 Feb 2025, a true reproduction of which is set out in
pages 719 through 823 of “JMK-3”

(b) A “Form 41” notice to admit that I completed on 17 Feb 2025, a true reproduction of
which is set out in pages 824 and 825 of “JMK-3”

(c) A “Form 69” originating application I completed on 17 Feb 2025, a true reproduction
of which is set out in pages 826 through 828 of “JMK-3”

  1. On 21 February 2024 I received from the Federal Court an email advising the
    documents referred to in paragraph 10 did not properly disclose a cause of action and so
    were rejected for filing. A true reproduction of the email is set out in page 829 of “JMK-3″
  2. On 22 February 2025 I sent to the Federal Court an email in reply to the email referred in
    in paragraph 11 above. A true reproduction of the email is set out in page 830 of “JMK-3″
  3. On 24 February 2025 I received from the Federal Court an email in reply to my email referred to in paragraph 12 above. A true reproduction of the email is set out in pages 831 and 832 of “JMK-3”.
  4. On 27 February 2025 I produced to the Federal Court registry, via eLodgment, documents that I intended to have filed in a proceeding I sought to commence against the Australian Human Rights Commissioner and others. These documents included:

(a) A “Form 18” notice that I completed on 27 Feb 2025, a true reproduction of which is set out in page 834 of “JMK-4”

(b) A “Form 69” originating application I completed on 27 Feb 2025, a true reproduction of which is set out in pages 835 through 838 of “JMK-4”

(c) A Statement of claim I completed on 27 Feb 2025, a true reproduction of which is set out in pages 839 through 873 of “JMK-4”

  1. On 03 March 2025 I received from the Federal Court an email advising that lodgement of my documents referred to I paragraph 14 above was “marked Pending’. A true reproduction of the email is set out in page 874 of “JMK-4”.
  2. On or around 03 March 2025 I produced to the Federal Court registry, via eLodgment, documents that I intended to have filed in a proceeding I sought to commence against the Australian Human Rights Commissioner and others. These documents included:

(a) A “Form 69” originating application enclosing a 16 Sep 2024 email from the Australian Human Rights Commission, a true reproduction of which is set out in pages 875 through 880 of “JMK-4”

(b) The “Form 18” notice referred to in paragraph 14(a) above

(c) The Statement of claim referred to in paragraph 14(b) above

  1. On or around 06 March 2025 I received by email from the Federal Court a letter concerning “Documents presented for filing on Monday 27 February 2025”. A true reproduction (before the addition of the Court seal) of the letter was annexed to the Form 66 originating application I filed in the proceeding.
  2. I believe I am removed “from the protection of the law’ in the meaning of 268.21 Criminal Code Act 1995.
