Details of claim

On the grounds stated in the statement of claim, accompanying affidavit or other document prescribed by the Rules, the Applicant claims:

  1. £500 in forfeiture, against each respondent — under s.9 Habeas Corpus Act 1679.
  2. Damages in s.5 Habeas Corpus Act 1640, against each respondent.
  3. Damages in tort, against the Commonwealth — under common law or s.80 Judiciary Act 1903 in the alternative.
  4. Exemplary damages in the amount of $100,000,000 against each of the first, second, and third respondents.
  5. Exemplary damages in the amount of $1,000,000 against the fourth respondent.

Claim for interlocutory relief

The Applicant also claims interlocutory relief.

  1. Rule 31.04(b) orders that this application and any accompanying document be served by delivering the documents to a person appointed by the Attorney-General of the Commonwealth to receive service, or by sending stamped copy of each document by email to processservice@ags.gov.au, and thereafter be taken to have been served on each respondent personally and in his capacity as officer of the Commonwealth.
  2. A Rule 16.31 order that the proceeding is to continue on pleading if the respondents don’t:
    a. apply for orders pursuant to subrule 13.01(1); or,
    b. file a notice of objection to competency; or,
    c. apply to the Court for the question of competency to be heard and determined before hearing of the application.
  3. An order reserving the costs of interlocutory relief.
